As per apna Qanoon, the enforcement of foreign judgments is the recognition and enforcement in one jurisdiction of judgments rendered in another (“foreign”) jurisdiction. Foreign judgments may be recognized based on bilateral or multilateral treaties or understandings, or unilaterally without an express international agreement.
Section 2(6) of the Code of Civil Procedure, 1908 (CPC) defines a foreign judgement as a judgement of a foreign court. A foreign court is defined by Section 2(5) of the CPC as a court situated outside Pakistan and not established or continued by the authority of the Central Government.
