As per apnaqanoon,In case a cheque is dishonored by the bank due to insufficient balance in account, the drawer of the cheque shall be deemed to have committed an offence and under the provision of Section 138 of The Negotiable Instruments Act, 1881, will be punished according to law/qanoon with imprisonment for a term which may extend to two years,
