As per apnaqanoon,Members of unlawful assembly are liable under Section 148 P.P.C. only when they are armed with deadly weapon. Had all the challaned accused persons being members of unlawful assembly used force resulting in violence in prosecution of the common object, they would have been liable to stand trial under Section 148 P.P.C.
