As per apnaqanoon,To invoke the provision of 249-A, two grounds are required which are as under; 1- charge is groundless , 2- there is no probability of the conviction of the accused. On the other hand, 265-k requires only one ground which is no probability of the conviction according to law/qanoon of the accused.
